What is legal funding? A person who has never experienced the difficulties of having a lawsuit would never understand what a legal funding is for or why it has gain a popular place amongst plaintiffs and their attorneys.
In its most basic sense, a legal funding is also known or called as Lawsuit funding, Law funding, Lawsuit loan, Lawsuit pre-settlement funding, Legal financing or Lawsuit cash funding. Now, what is legal funding again? It is cash made available directly for plaintiffs for any purpose that they need during the appeals process, a trial, before arbitration or when a lawsuit comes to a final settlement.
Who should be granted legal funding? The person who benefits from legal funding is always the plaintiff. The reason behind this is that a plaintiff is often the person who receives more damage. For instance, a heavy case such as the plaintiff needing to go to the hospital for medication means that there is absence from work. We can all understand that when one isn’t working, there is also no income. So, in the event that a lawsuit is necessary but with very limited fund, a legal funding is a good approach to cover financial needs that are important for the entire lawsuit process.
A plaintiff has to keep in mind though that there must be an attorney to support their appeal because the main reason is for them to win the lawsuit despite the financial setback. Legal funding is already a big help because despite the defendant being away from work due to injury or emotional distress caused by the incident, it is made to be available at the most critical time.
Some plaintiffs who wanted to file a lawsuit because of the damages caused from any type of incident oftentimes avoid filing it altogether because of one reason – and it’s always almost similar – financial constraints. If we try to think about it, a plaintiff has all the rights to file a complaint or a lawsuit especially if they have been damaged in such a large scale but since there is a huge amount of money involved to settle the entire lawsuit process, they back down.
Hopefully, legal funding in the future becomes even more popular and known to each person so when it’s necessary to file a lawsuit, it gets done the proper way and justice is served.
